    Claiming compensation for accidents on escalators

    We all appreciate escalators and lifts when our legs are tired after a long day of shopping, or we are in a rush to get somewhere and can’t face the many flights of stairs. However, whilst escalators and lifts are generally very safe, they have been known to malfunction and cause users injury.

    One need only look at the recent incident in a New Jersey PATH station where 5 commuters were injured as an escalator malfunctioned. The escalator stopped and then started to reverse at considerable speed causing some people to jump from the escalator and others to pile up at the bottom leading to neck and back injuries for example.

    Whilst no one was seriously injured in the New Jersey incident, it could have been a lot worse and demonstrates the potential risks of having an escalator accident for which you were not to blame. In some cases it may be clear whose negligence was to blame for the accident occurring, however in other situations it will be more challenging to establish who is liable.

    Those working in the building in which the escalator is installed are responsible for ensuring that the escalator is functioning. Escalators must be properly maintained and checked regularly to ensure that they are in safe working order and do not pose any risks to users.
